USER MATERIALS By submitting ads, content, photos, data, or other materials to the site, or have you photo taken, or hunting with us you hereby grant having Razzor Ranch and it’s affiliates and subsidiaries a royalty free, perpetual,irrevocable,non exclusive, fully transferable, fully sublicensable right and license to copy, modify, display, distribute, perform, create, derivative works from,and otherwise use and exploit all such materials in any form , media,software or technology of any kind now existing or developed in the future. You further grant to Razzor Ranch and its affiliates and subsidiaries a royalty- free right and license to use your name,image and likeness in connection with the reproduction or distribution of materials. You hereby waive your moral rights in your submissions, to the extent such rights can be waived, under any existing or future law of any jurisdiction. Razzor ranch takes no responsibility and assumes no liability for any materials posted by you or any third party. RAZZOR RANCH RIGHTS Razzor Ranch does not monitor the materials , forums or listing services ( content ) posted or transmitted by you and/ or other third party information providers. Razzor Ranch reserves the right, in its sole discretion, to review, refuse to publish, remove, delete, move or edit any content without notice, at any time for any reason or no reason. INDEMNIFICATION By using this site, visiting, hunting, or participating in any capacity at Razzor Ranch or property used by, weather owned or leased, you agree to indemnify, defend, and hold Razzor Ranch, and its owners, officers, guides, subsidiaries, agents , employees, contractors, directors, service providers, beneficiaries, trustees, harmless from and against any losses, actions, claims, proceedings, suits, judgments, settlements, or liabilities, (“claims”),and all resulting losses, damages, liability,  fees, liens, assessments, penalties, judgments, costs, and expenses (including reasonable attorneys’ fees ). Made or initiated by any third party due to or arising out of your use of the site, property, or services. GUIDES USE OR SERVICES By using, hunting with or reliance on any guide, owners, agents, or contractors while visiting Razzor Ranch you agree that any and all information, agreements, in reference to any animal, bird, or any game hunted is only an estimate in Reference to size, weight ,sex, condition, species, or score. You fully understand and agree that This estimate may not be correct and you fully understand to only rely on any information given as an estimate. You further agree and understand that you the hunter make your own decisions on sex, size, condition, species, or score of any animal or bird hunted at Razzor Ranch and you take full responsibility on any game shot. ACCESS AND USE Access to the site or to portions thereof, or access to services we provide, may be occasionally interrupted to preform changes or necessary maintenance;  or for certain types of  force “nature” events ( e.g, “acts of god “ , weather calamities, riots, wars, internet connectivity issues, etc. ) beyond the reasonable control of Razzor Ranch for witch Razzor Ranch.com shall have no liability. GOVERNING LAW; JURISDICTION These terms & conditions,  any transactions consummated there under, and any other disputes related in any way to your access to and use of this site and or it’s services shall be governed by and construed under the laws of United States and of the state of Florida, without regard to conflicts of law principles or rules thereof. Any legal action arising out of or related to these terms & conditions or your access to and use of this site and or its services must be commenced within one year after the cause of action arises. You agree and understand that Razzor ranch and its owners waive your respective right to trial by jury. Razzor Ranch and you agree to use best efforts to settle any dispute or claim arising out of, or relating to, these terms & conditions or your access to and use of this site and or it’s services. If Razzor Ranch and you cannot reach a written settlement agreement within 30 days of the raising of the controversy or claim, you shall submit the dispute to binding arbitration to take place in the state of florida, in the county of Charlotte. WARRANTY DISCLAIMER YOU EXPRESSLY AGREE THAT USE OF THIS SITE AND RELIANCE ON ITS CONTENT IS AT YOUR OWN RISK. All information related to animals and or services available on this site is supplied for information purposes only and may not be 100 percent accurate. Razzor Ranch and it’s owners, guides, employees make no representation or warranties, expressed or implied, to any actual hunter or person using or visiting as to sex, size, species, weight, condition of any animal or bird at our place of business or this site. PROMOTIONS All promotions are subject to availability and inventory. Razzor Ranch reserves the right to change, alter. Or cancel promotions at any time without notice. REVISIONS Razzor Ranch may at times revise these terms & conditions by updating this posting. You are bound by any such revisions and thereby you should therefore periodically visit this page to review the current terms & conditions to witch you are bound to. COOKIES See Privacy Policy DEPOSIT POLICY Unless otherwise stated, any deposit amount place on a credit card, or any other kind of deposit used to hold any hunting date, cabin, outdoor adventure, fossil hunt, or any other activity at Razzor Ranch, or it’s affiliates is non refundable and can not be returned for any reason. Razzor Ranch and or its owners, and managers reserve the right to transfer any deposit to another date at our discretion, if requested. All deposits are for hunting dates and NOT animals, at times an animal may not be available, or has been shot before a clients hunt. No Animals of any kind can or will be saved for any client at any time. We advise all depositors to purchase a third party insurance policy to protect any deposit incase a date can not be made, or any delay in travel happens. We will do our best at our discretion to help any client on transferring a deposit if we can. CHECK IN POLICY The minimum check in age is 21, and a valid form of government ID is required at check in. Check in time on your reservation can not be earlier than the time texted to the person booking the outdoor adventure. ( you will receive a text with your booking date and time to show ) with out prior approval of management, late check in after arrival time on your booking text will not be accepted. We do not live on the ranch, and our guides that greet clients a pond check in MUST get their sleep for the morning hunts and can not, without approval stay up late waiting on clients to show. (Please contact us and make sure we can take any late arrival showing. ) NO SHOW POLICY/ NONE BOOKED CABIN USE In the event a client/guest No shows to the ranch, or chooses not to check in for any reason into a booked cabin, the guest/client forfeits any deposits held for the cabin and at our discretion will be charged for any unused dates that was booked. ( do to the fact at time we have to turn down other bookings ) OVERBOOKING & RELOCATION POLICY In the extraordinary event of non availability, due to over booking or any other unforeseen circumstances, or acts of god. We will try our best to book our clients in town at a hotel at the hotels current rate to be paid by the client. CABIN TYPES At no time will we guarantee any certain cabin to any guest, at times a cabin of a certain type may not be available, is booked, occupied, or not in service at a time when wanted, or needed. MAXIMUM OCCUPANCY POLICY Due to safety and fire code requirements, there is a maximum occupancy limit set on any cabin at the ranch. This person limit is set by management and cannot be changed. ( please ask at booking for limit per certain cabins ) DAMAGE POLICY Damage to the property committed by any guest/client or person while on the ranch grounds, including but not limited to cabins,stands,barn,office, sheds, or cleaning station and/or property amenities,fixtures, furnishings, decor, linens, tvs, or other owned property, will incur additional charges that will be assessed to the guest/client or person, which is subject to the type and extent of the damage, per ranch owners discretion, but not to exceed 150% of fair replacement value and the cost of any labor. Furthermore, any guest/client or person who negligently or intentionally causes damage to Razzor Ranch grounds, cabins or any property shall be liable for damages sustained by the staff and owner, including the Ranches loss of revenue resulting from the inability to use, book, any cabin,or property while the damage is being repaired. Willful and intentional property or other damage to Razzor Ranch property will be reported to appropriate law enforcement agency and Razzor Ranch/owners reserves the right to pursue criminal and civil charges against those who commit acts of property or personal destruction. DOG FRIENDLY POLICY Razzor Ranch location is dog friendly. Please note that all dogs must be house broken, none aggressive in any way, and on a leash when out of any cabin or barn. We at Razzor Ranch are Not responsible for any loss or hurt dog due to any circumstances or contact with any other animals or guns. A deposit of $500 per dog is required to have your dog stay at Razzor Ranch. This deposit will be returned if no damage is found, or extra cleaning is needed. NONSMOKING POLICY All our cabins,barns or office are non smoking areas, and any guest found to have been smoking, vaping, or using an E cigarette in any indoors will be assessed a smoking & specialty cleaning fee of $300 for additional cleaning and or repairs. COMPLIANCE WITH LAWS! Use of site is at your own risk. You assume full responsibility and risk of loss resulting from your downloading and/or use of content and services,and any other information,content, or materials accessed through or obtained by means of the site. Under no circumstances shall Razzorranch.com or its affiliates and subsidiaries, or their respective directors, provider, or licensor, guides,employees and agents,owners, trustees, or other owners, suppliers, provider, or licensee, be liable for any indirect, incidental, punitive, special, or consequential damages (including but not limited to damages for personal injury and/or death, lost revenues or profits, loss of business, or loss of data ) that are directly or indirectly related to your use of or inability to use the site, services, and/or content, even if advised of the possibility of such damages, regardless of weather such liability is based in tort (including negligence), contract or any other legal or equitable theory. It is solely your responsibility to evaluate the accuracy, completeness and usefulness of the site, services, and/content.  Some States do not allow the exclusion or limitation of liability for these kinds of damages, so the above limitations or exclusions may not apply to you. SECURITY Razzor ranch does not guarantee or warrant that the site, services, or any content thereon will be free from infection, viruses, worms, Trojan horses, or other codes or features that manifest contaminating or destructive properties, nor can Razzor ranch provide any assurance that unauthorized persons will not be able to access your computers, or data systems by means of use or our site or systems or through use of any of our email addresses, user names or other information or content unauthorized persons may find on the site. You are responsible for implementing sufficient procedures and checkpoints to satisfy your particular requirements for system security, accuracy of data input and output and for maintaining your own means for the reconstruction of any lost data or otherwise dealing with system security breaches. Even with the use of encryption, you acknowledge that the internet is not 100 percent secure medium and privacy cannot be guaranteed. Razzor ranch, owners, trustees, or beneficiaries will not be responsible for any damages you or any third party may suffer as a result of the transmission that you make to razzorranch.com through the internet, or that you expressly or implicitly authorize razzorranch.com to make, or for any errors, data corruption or any changes made to any transmitted information.
